Updated for 2026. Hemp and marijuana are both members of the Cannabis sativa family, but federal law classifies them as separate products. The 2018 Farm Bill defines hemp as cannabis containing β€0.3% Delta-9 THC by dry weight; anything above that line is marijuana. As of November 12, 2026, hemp-derived products are further governed by H.R. 5371, which caps total THC per finished container regardless of cultivar.
